1.1. These Terms and Conditions govern the business relationship between Marsupia and the person who contracts the service (hereinafter, the "Contracting Party"): what the service includes, how it is activated, how it is billed, how it is cancelled, and under what law it is governed.
1.2. The processing of personal data — what is processed, for what purpose, and for how long — is governed by a separate document: the Data Processing Policy. Both documents must be read together; on matters of personal data, the Policy prevails.
1.3. By activating the service, the Contracting Party accepts these Terms and Conditions and the Data Processing Policy in full.
2.1. Marsupia is a digital family companionship service. Based on the technical connection records of the protected devices, it delivers two periodic reports to the family in plain language — La Bitácora and La Brújula — with observations on digital habits and suggested conversation topics.
2.2. Human review. No report is sent to a family without being reviewed by a person first.
2.3. What the service does not do. Marsupia does not read conversations, messages, or personal content, does not guarantee the detection of every possible risk, and no protection configuration is infallible. The service helps reduce risks and supports digital parenting; it does not replace the family's own supervision or judgment.
2.4. Applying the technical configuration described in the activation wizard depends on correct installation on each device, carried out by the Contracting Party or by whomever Marsupia designates to assist with that step.
3.1. Marsupia offers three plans — Semilla, Nido, and Travesía — which differ in the number of devices included at no extra cost. The plans, included devices, and current prices are published on the plans page and are as follows:
3.2. An additional device beyond those included in the plan costs $15,000 COP/month per device.
3.3. The subscription is billed on a monthly or annual cycle, at the Contracting Party's choice. Under the annual cycle, the amount charged corresponds to ten (10) months, covering twelve (12) months of service.
3.4. All plans include a cost-free period of fifteen (15) days — see the activation and billing details in Section 4. Under the annual cycle, this period is added to the discount inherent to that cycle (clause 3.3): a total of two (2) months and fifteen (15) days at no cost.
3.5. The current payment method is bank transfer to the @marsupia key. Marsupia notifies the Contracting Party of the monthly charge via WhatsApp, together with a QR code to complete the transfer. When Marsupia enables an electronic payment gateway, this document will be updated to reflect the new payment method, in accordance with the procedure set out in Section 9.
Note: amounts are stated in Colombian pesos (COP), the service's actual billing currency — this is the legally governing figure, regardless of any reference currency shown elsewhere on the site.
This section governs when and how the service is activated, and the consent given by the contracting adult. Express authorization for the processing of personal data of minors is granted and documented separately, in the Data Processing Policy, which this section references and does not replace.
4.1.1. Activating the service requires the prior, express, and informed consent of the contracting adult (hereinafter, the "Contracting Party"). Consent cannot be inferred from silence or mere inaction.
4.1.2. The Contracting Party expresses consent through electronic means — including acceptance via WhatsApp, completing the family setup form, or checking an acceptance box — means which, under Law 527 of 1999, have full legal validity and binding force.
By activating the service, the Contracting Party declares, under their own responsibility, that:
4.2.1. They are of legal age and have full legal capacity to enter into this contract.
4.2.2. They are the father, mother, legal representative, or guardian with sufficient legal authority to authorize the processing of the data of the minor(s) included in the service, either because they hold parental authority or custody, or because they have the authorization of whoever holds it.
4.2.3. The information they provide about themselves and about the minor is truthful, complete, and up to date, and they undertake to keep it up to date for as long as the service remains active.
4.2.4. If another father, mother, or legal representative of the minor exists, the Contracting Party declares that they have the necessary consent or legal authority to authorize the service, and will hold Marsupia harmless against any third-party claim arising from the lack of such authority or consent.
4.3.1. The service is activated once the Contracting Party has completed, in any order and through the means enabled by Marsupia, the following steps:
4.3.2. The fifteen (15) day cost-free period provided for in this document begins to run from the moment of activation.
4.3.3. Marsupia will not begin the technical configuration or the processing of the minor's data until the authorization recorded under clause 4.3.1 has been obtained.
By activating the service, the Contracting Party undertakes to:
4.5.1. All plans include a fifteen (15) day cost-free period, which begins upon activation of the service. Under the annual plan, this period is added to the discount inherent to that billing cycle (ten months of payment cover twelve months of service): a total of two (2) months and fifteen (15) days at no cost.
4.5.2. At the end of that period, continuation of the service is subject to payment of the subscription, under the billing cycle (monthly or annual) chosen by the Contracting Party.
4.5.3. The first charge is incurred only if, once the free period has elapsed, the Contracting Party has not cancelled the service through the official channels.
4.5.4. Marsupia will send the Contracting Party a reminder notice five (5) calendar days before the first charge.
4.6.1. The fifteen (15) day cost-free period also serves as an evaluation period during which the Contracting Party may cancel the service at no charge, through the official channels.
4.6.2. Additionally, where the right of withdrawal provided for in Article 47 of Law 1480 of 2011 for distance sales applies, the Contracting Party may exercise it within the following five (5) business days, under the terms of that law.
5.1. Once the fifteen (15) day cost-free period and the applicable withdrawal period (clause 4.6) have elapsed, the subscription renews automatically at the end of each cycle (monthly or annual), unless cancelled by the Contracting Party through the official channels.
5.2. The Contracting Party may cancel at any time through Marsupia's official channels. Cancellation takes effect at the end of the current billing cycle; Marsupia does not issue refunds for time already billed, except as provided under the right of withdrawal (clause 4.6).
6.1. The symbol, the name "Marsupia," and the design of the platform, the site, and the reports are the property of Marsupia. This clause grants the Contracting Party no rights over them beyond the use of the contracted service.
6.2. Reports (La Bitácora, La Brújula, whether in text, PDF, or audio form) generated for a specific family are for that family's personal use — to support them in accompanying the minors in their care — and may not be redistributed or used for commercial purposes.
7.1. Marsupia acts with the diligence appropriate to its activity, but does not guarantee results: no digital protection tool completely eliminates the risks minors are exposed to online. Marsupia seeks to reduce those risks and support the family, not to eliminate them or to assume the supervisory responsibility that belongs to the Contracting Party.
7.2. Marsupia is not responsible for connectivity failures, device failures, or failures of third-party providers outside its control that affect the availability of the service.
These Terms and Conditions are governed by the laws of the Republic of Colombia. Any dispute arising from their interpretation or performance shall be submitted to the competent courts of Barranquilla, Atlántico, Colombia, without prejudice to the consumer protection mechanisms provided for in Law 1480 of 2011.
These Terms are effective as of the date indicated at the beginning of this document. Marsupia may amend them to reflect changes in the service or in applicable regulations; substantial changes will be communicated to the Contracting Party through their registered contact channel, at least ten (10) calendar days in advance. The current version is always available at https://www.marsupia.co/terminos
